Employment-based immigrant petitions may be filed by an employer on behalf of individuals seeking to work in the United States on a permanent basis. There are three major categories of employment-based immigration:
- EB-1 (Priority Workers)
Aliens with extraordinary abilities in the arts, athletics, business, education, and the sciences may apply for an immigrant visa, which in turn will allow them to apply for lawful permanent residence.
- EB-2 (Advanced Degree Professional or Aliens with Exceptional Ability)
Workers who (a) are members of professions holding advanced degrees or their equivalent or (b) will benefit the economy of the United States because of their exceptional ability in the arts, business, and science, may also apply for immigrant visas. This will allow them to apply for lawful permanent residence.
- EB-3 (Skilled Workers, Professionals, and Others)
Individuals with bachelors degrees or their equivalent and skilled workers holding or seeking positions that require at least two (2) years of training or experience may also apply for immigrant visas. This will also allow them to apply for lawful permanent residence.
